CyberLNC.com provided its customers (also known
as subscribers) with web hosting services.
CyberLNC.com respects that the Internet is a
medium for free and open discussion and
interpretation of information, however, when
there are conflicting or legal issues,
CyberLNC.com may take corrective actions to
resolve these issues. In order to stop these
issues occurring, CyberLNC.com has an Acceptable
Use Policy ("AUP"), which details terms that the
customer is bound to while using our services.
This AUP can and will be revised at any time. If
a customer continues using CyberLNC.com services
after this AUP is modified, it signifies to us
your agreement with these terms.
As the internet cannot be monitored, it is
possible for CyberLNC.com customers to use our
services in a way which could offend or injure
them. CyberLNC.com is not responsible for any
injury or offense caused by using our services.
Internet users must remember that they are bound
by many laws regarding use of the internet.
CyberLNC.com customers are no exceptions. Any
illegal activities that break the terms of this
AUP may face criminal or legal action and/or
account termination. Some activities prohibited
on our servers are listed below:
1. Spam
Sending unsolicited email messages (sometimes
known as "spam") is treated with a 0% tolerance
policy. It is not allowed not only because of
the negative impact it has on CyberLNC.com's
name, but also because it can overload
CyberLNC.com's network and disrupt service to
other CyberLNC.com customers. Maintaining an
open SMTP relay which could be abused by others
is also not allowable. CyberLNC.com reserves the
right to decide whether users on a mailing list
have "opted in" and will take action
accordingly.
2. Export Control Violations
Exporting certain types of encryption software
to regions which are forbidden from using the
technology is not allowed.
3. Obscene Speech or Materials
Using CyberLNC.com's services to make available
child pornography or obscene speech or material
is not tolerated. CyberLNC.com will notify the
appropriate law enforcement agencies if these
issues arise.
4. Distribution of Internet Viruses or Other
Destructive Activities
Distributing information regarding how to create
or engineer a virus, worm or other destructive
software is not allowed. You may not willingly
send others destructive software or host
destructive software for others to use.
5. Defamatory or Abusive Language
Using CyberLNC.com's services as a means of
encouraging, defamatory or abusive language is
not allowed.
6. Forging of Headers
Misrepresenting or forging email headers whether
completely or in part is forbidden whilst using
CyberLNC.com services.
7. Unauthorized or Illegal Access to Other
Computers or Networks
Attempting to penetrate security measures others
have put in place ("hacking") and any activity
that is a prerequisite of hacking (for example:
port scanning) is strictly forbidden using
CyberLNC.com services.
8. Facilitating a Violation of this AUP
Creating or advertising a product which is not
allowed in this AUP is prohibited on
CyberLNC.com servers. Examples of this would be
software designed to spam or packet flood.
9. Intellectual Property Violations
You may not use CyberLNC.com's services to
violate intellectual property rights, including
copyrights, trademarks, service marks, trade
secrets, software piracy, and patents held by
individuals, corporations, or other entities.
Also, engaging in activity that violates
privacy, publicity, or other personal rights of
others is not allowable. CyberLNC.com is
required by law to remove or block access to
customer content upon receipt of a proper notice
of copyright infringement, and we will.
CyberLNC.com will disable service to customers
who commit repeat violations of copyright laws.
10. Other Illegal Activities
Using CyberLNC.com services for means that are
determined to be illegal, including relations
with pyramid schemes, credit card fraud, and
pirating software is forbidden.
11. Other Activities
You may not engage in activities, whether lawful
or unlawful, that CyberLNC.com determines to be
harmful to its service.
CyberLNC.com reserves the right to terminate
service to a customer who we feel is involved in
any harmful activities.
You are responsible for keeping the content of
your hosted sites in accordance with this AUP.
If a problem arises on one of your domains, you
are fully responsible. Examples of this could be
forum posts or resold accounts.
We will try our best to keep your information
safe, using SSL encryption whilst processing
your credit card information, and safely storing
your information on our servers. However, no
computer system is completely secure. Due to
this fact, we urge our customers to treat all
online communications as insecure. We will take
no liability for damage caused if your
communications are intercepted or broken into.
CyberLNC.com will not intentionally monitor or
censor communications from a customers account
unless required to do so by law. We may, if the
law requires us to, disclose your personal
information to the appropriate authorities.
If legal action is taken against CyberLNC.com
because of a customer's activity, the subscriber
will pay any damages awarded against
CyberLNC.com, plus costs and all legal fees.
